"Belaire Owners Association and Park Place Residents Welfare Association welcome order by CCI to rectify abusive clauses in DLF's agreement with allottees of apartments in Belaire and Park Place Group Housing Schemes, Phase V, Gurgaon," the two associations said in a joint statement.
Yesterday, CCI had said that "the apartment buyers agreement has been amended such that the abusive and unfair conditions present in the original one-sided agreement have been removed" following a direction from the Competition
Appellate Tribunal (COMPAT), where DLF had challenged Rs 630 crore penalty imposed on it by the competition regulator. Commenting on the order, Belaire Owners Association President Sanjay Bhasin said: "Some of the main terms that DLF has violated are- insufficient land area for the Belaire Group Housing Scheme as per FAR norms, delay in handing over the possession with no or insufficient compensation, illegal charging of parking places, construction of 10 extra floors without consent from allottees etc."
The buyers' compensation claims, which will be submitted to COMPAT, will be based on all these violations, he added. The statement further said the collective compensation claim from all the allottees will far exceed the fine of Rs 630 crore imposed by the CCI. The COMPAT had asked the CCI in March, 2012 to pass an order specifying the extent and manner in which terms and conditions of the Apartment Buyer's Agreement need to be modified.
