Govt's decision to implement GAAR in '14 not negative: KPMG

In an exclusive, CNBC- TV18 reports, quoting sources, that the finance minister has rejected the Shome Panel's recommendation to defer implementation of GAAR by three years. In fact, the finance minister is in favour of rolling out GAAR from April 2014.

Deputy CEO KPMG Dinesh Kanabar explains to CNBC-TV18 that the implementation of GAAR in 2014 still allows a two-period for public debate and if all the recommended safeguards are followed, investors have no cause for concern.

Below is an edited transcript of the analysis on CNBC-TV18.

Q: What is your opinion on this development?

A: Since the development has been indicated by sources, it is uncertain how this is likely to eventually pan out. But lets look at how facts have played out. Originally GAAR was to be implemented with effect from April 1, 2012 but because of the Opposition it got postponed to April 2013 and now, there are indications of its implementation in April 2014. So, in a sense, there is a deferment by two years.

The Shome Committee made some very interesting observations. It first ascribed the reason for the deferment of GAAR to allow the conduct of a larger debate between stakeholders within a time-frame of three years.

Even if GAAR is going to be implemented from April 2014, it still allows enough room for a meaningful debate between the stakeholders. More importantly, the Shome Committee observed that even if GAAR was to be recommended, it would protect the investments already made.

The committee also pointed out that the implementation of GAAR had to be objective instead of subjective. To my mind, if all those recommendations have been accepted and implemented, then the rigours of the GAAR are so considerably mitigated that one may not have an objection to its implemented from 2014. I don't think it is likely to impact investor-sentiment.

Q: Is the government indicating that the implementation of GAAR will no longer be its responsibility?

A: I wish to refrain from commenting on the political aspects of GAAR. The Shome Committee actually heard out all the stakeholders. So, I think that even if GAAR is implemented from 2014 instead of 2015, the period of deferment is already two years and more importantly, if all the safeguards are built-in, investors should not have cause for concern.
